Defect Report – Window Installation

Dobson-Grey Ltd. was instructed to provide an Expert Witness Defect Report. Our lead surveyor, an experienced Chartered Surveyor and Registered Valuer, led the technical investigation. Their extensive background in RICS HomeBuyer Condition Surveys, valuations, snagging, and project management of window installations in heritage properties provided the foundation for a comprehensive assessment. The report was meticulously prepared in accordance with Civil Procedure Rules, Civil Justice Council Guidance, and relevant RICS Practice Statements, ensuring its suitability for dispute resolution.

Our team conducted multiple internal and external visual inspections of the property’s windows. We utilised a range of professional equipment, including laser levels, a thermal imaging camera, spirit levels, and a moisture meter, to thoroughly assess the windows and their installation. The investigation focused on two key questions:

  • Whether the windows themselves were patently defective.
  • Whether the workmanship of the installation met the reasonable standards expected of a certified company.

The assessment rigorously compared observed conditions against relevant industry guides and applicable Building Regulations, noting the absence of a Building Regulations application for the installation.

The Dobson-Grey report provided a clear, independent, and evidence-based opinion confirming both manufacturer defects and significant deficiencies in the installation workmanship. It underscored that the installer’s work fell short of the standards expected of a competent contractor and contradicted their own marketing claims.

The report also highlighted that as a certified company, the installer could face a retrospective non-conformity levy if the installation is officially deemed non-compliant, potentially incurring significant costs. This comprehensive expert assessment provides the client with a robust foundation for pursuing appropriate rectification or rejection, supporting their position in the ongoing dispute.
