Expert Witness Valuation for Matrimonial Dispute

Dobson-Grey was appointed as a Single Joint Expert to provide an independent Expert Witness Valuation Report for a private client involved in financial remedy proceedings at the Birmingham Civil and Family Justice Centre. The service, compliant with Part 25 of the Family Procedure Rules 2010 and RICS Valuation – Global Standards, required an impartial valuation of two distinct properties (Property A and Property B) to determine their Market Value as at specific valuation dates, assuming vacant possession and unencumbered freehold titles.

Keri Dobson, a Registered Valuer with extensive experience in expert witness valuations, conducted thorough inspections of both properties. Our valuation process adhered to strict professional standards, considering a wide range of factors influencing property value. The report’s scope was limited to general condition comments, not a structural survey, and excluded plant and machinery valuations.

Key Aspects of the Valuation

As a RICS – regulated Chartered Surveyors, we acted as a Single Joint Expert Witness, adhering to RICS Red Book standards.Our approach involved:

  • Property A: A large, Grade II listed residential dwelling with extensive land (13.243 hectares within the Green Belt) and various outbuildings, including a threshing barn, stable block, and modern warehouse. The valuation considered the property as a whole, anticipating interest from individuals seeking agricultural/equestrian facilities or high-net-worth individuals interested in a hobby farm. It also accounted for an element of “hope value” for potential redevelopment of the barns, despite previous lapsed planning permissions.
  • Property B: A 5-bedroom detached residential dwelling in Barnt Green, a sought-after area. The valuation considered local market conditions, including a general slowdown in demand for properties above £750,000, while highlighting Property B’s desirable cul-de-sac location with a gated entrance and detached garage as premium features.

Dobson-Grey delivered a comprehensive and impartial opinion of Market Value for both properties, totalling £4,125,000 (£3,200,000 for Property A and £925,000 for Property B). This expert assessment provides a clear and robust valuation to assist the court in the financial remedy proceedings, ensuring all relevant factors, complexities, and market conditions were meticulously considered according to RICS standards.
